Refund Policy

§1. General Provisions
- 1.This Refund Policy (the “Refund Policy”) governs the rules for refunding the purchase price and termination of the licence for the FLEDIT plug-in (the “Product”) purchased by end users through the Gumroad platform (gumroad.com). The Product is downloadable digital software activated by a licence key.
- 2.Gumroad acts as merchant of record, i.e., it is the seller vis-à-vis the purchaser, collects payment, settles indirect taxes, and handles refunds, chargebacks, and disputes.
- 3.The Provider grants the licence (EULA), but does not accept payments directly and does not issue invoices to purchasers.
- 4.For the purposes of this Refund Policy:
- a)“Provider” means the Licensor to the extent that it supplies the Product to the Gumroad platform for resale to purchasers (Ekipa management sp. z o.o., with its registered office in Kraków);
- b)“Purchaser” means a natural person or legal entity that purchases the Product through the Gumroad platform.
§2. Nature of the Product - Digital Content and Licence
- 1.The Product is downloadable digital content (a plug-in for Adobe Premiere Pro on Windows and macOS) sold globally and activated using a device-bound licence key (HWID).
- 2.Upon purchase, the Purchaser receives access to the licence key. Upon its activation, digital content is supplied within the meaning of consumer law, and the Licensor enables use in accordance with the EULA.
- 3.Due to the nature of the licence and the impossibility of “returning” a licence key without the risk of continued use of the Product, refunds are subject to the limitations set out below.
§3. Right of Withdrawal
- 1.The Provider grants all Purchasers the right to withdraw from the contract concerning digital content within 14 days from the date of its conclusion. For consumers residing in Member States of the European Union, this period is at least equivalent to their statutory right to withdraw from a contract in respect of digital content.
- 2.The statutory right of withdrawal is exercised through Gumroad, which, as seller, receives the declaration, refunds the payment, and informs the Licensor. Upon effective withdrawal, the licence for the Product expires and the related licence key may be blocked.
§4. Chargebacks
- 1.The Purchaser may initiate a dispute procedure with the provider of the payment method (e.g., a bank or card operator). In such a case, Gumroad, as the entity processing the payment and merchant of record, is obliged to handle the chargeback and treats it as a refund of the purchase price.
- 2.In the event of a chargeback, the licence for the Product expires and the licence key is blocked; Gumroad may also block the Purchaser’s account in order to protect against abuse.
- 3.The Licensor is not obliged to continue providing technical support or updates to a Purchaser whose transaction has been reversed by way of a chargeback.
§5. Effect of a Refund on the Licence and Use of the Product
- 1.Any effective refund (statutory withdrawal, voluntary refund, or chargeback) results in the expiry of the licence for the Product granted to the Purchaser under the EULA.
- 2.Upon expiry of the licence, the Purchaser is obliged to:
- a)cease using the Product;
- b)uninstall the Product from their devices;
- c)refrain from using the licence key or any mechanisms for its reactivation.
- 3.The Licensor is entitled to deactivate or block the licence key associated with the transaction to which the refund relates, and to apply additional technical measures preventing the Purchaser’s continued use of the Product after the refund.
§6. Limitations on Product Refunds
- 1.The Refund Policy does not apply to situations in which the Purchaser:
- a)has not reviewed the Product’s technical requirements;
- b)has used the Product in a manner contrary to the EULA (e.g., licence infringement or reverse engineering);
- c)requests a refund after prolonged, normal use of the Product without technical problems.
§7. Information for the Purchaser and Consistency with the EULA
- 1.Information on this Refund Policy is made available to Purchasers on the product page and in the product settings in the Gumroad system (the “Refund policy” section), in a language consistent with the version of the page.
- 2.The EULA for the Product provides that, in the event of an effective refund (in any mode), the licence expires and the licence key becomes invalid.
- 3.This Refund Policy does not limit consumers’ rights arising from mandatory provisions of law applicable to the Purchaser.
§8. Applicable Law and Jurisdiction
- 1.This Refund Policy is governed by the law specified in the EULA for the Product.
- 2.In matters not regulated by this Refund Policy, the provisions of the EULA and mandatory provisions of law applicable to the Purchaser shall apply.
- 3.Any disputes related to this Refund Policy shall be subject to the jurisdiction of the courts specified in the EULA, subject to any different consumer rights arising from mandatory provisions of law.
